These Terms of Service ("Terms") govern your use of the CogiTrain mobile application ("App"), operated by Marty The Creative ("we," "our," or "us"). By downloading or using the App, you agree to these Terms.
CogiTrain is a cognitive training application designed for personal, non-commercial use. You agree to use the App only for its intended purpose and in compliance with all applicable laws.
You must be at least 13 years of age to use the App. By using the App, you represent that you meet this requirement.
CogiTrain offers a free tier available to all users and a paid Pro subscription that unlocks additional features including full session history, detailed statistics, performance benchmarks, and cognitive age estimates.
The free tier provides full access to all five training modes at all difficulty levels with no gameplay restrictions.
CogiTrain is designed for cognitive entertainment and general mental fitness. It is not a medical device, diagnostic tool, or treatment for any medical or psychological condition. Nothing in the App constitutes medical advice.
If you have concerns about your cognitive health, consult a qualified healthcare professional. Do not use CogiTrain as a substitute for professional medical evaluation or treatment.
All content in the App, including but not limited to the CogiTrain name, design, training paradigms, code, and graphics, is owned by Marty The Creative and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding specific cognitive outcomes from use of the App.
To the fullest extent permitted by law, Marty The Creative shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim.
We reserve the right to modify or discontinue the App or any part of it at any time. We may also update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Continued use of the App after changes constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
